Socialee is an AI-powered marketing automation platform operated by:
- Malaysia: Gaman Group Sdn Bhd, a company incorporated under the laws of Malaysia
- Thailand: White Ball Company Co. Ltd, a company incorporated under the laws of Thailand
References to "Socialee," "we," "us," or "our" refer to the above entities as applicable to your jurisdiction.
2. Acceptance of Terms
By accessing or using Socialee, you confirm that you:
- Are at least 18 years of age
- Have the legal authority to enter into this agreement on behalf of yourself or your business
- Have read, understood, and agree to be bound by these Terms
- Agree to comply with TikTok's Terms of Service and Community Guidelines
3. Description of Service
Socialee provides the following services through its AI-powered platform:
- AI-generated content ideas, scripts, captions, and hashtags for TikTok, Facebook, and Instagram
- Automated or scheduled posting to TikTok via the TikTok Content Posting API
- Automated or scheduled posting to Facebook Pages and Instagram Business accounts via the Meta Graph API
- Performance analytics retrieval via the TikTok Research API and Meta Insights API
- Content optimisation recommendations based on performance data
- Trend monitoring and strategic content suggestions
The platform acts as an intermediary tool. Users remain fully responsible for all content published to their TikTok, Facebook, and Instagram accounts through Socialee.
4. TikTok API Usage & Your Responsibilities
Socialee integrates with TikTok and Meta (Facebook and Instagram) developer APIs. By connecting any social media account, you:
- Authorise Socialee to post content to your TikTok account on your behalf via the TikTok Content Posting API
- Authorise Socialee to post content to your Facebook Pages and Instagram Business accounts on your behalf via the Meta Graph API
- Authorise Socialee to retrieve analytics data for your posts via the TikTok Research API and Meta Insights API
- Acknowledge that you remain solely responsible for all content posted to your accounts through Socialee
- Agree to comply with TikTok's Terms of Service, Community Guidelines, and Advertising Policies
- Agree to comply with Meta's Terms of Service, Community Standards, and Platform Policies for Facebook and Instagram
- Confirm that any content posted through Socialee will not violate platform policies or applicable laws
You may revoke Socialee's access to any connected account at any time through that platform's app or account settings.
5. Content Ownership & AI-Generated Content
You retain ownership of all content you create or publish through Socialee. Regarding AI-generated content:
- AI-generated scripts, captions, and suggestions are provided as tools to assist you — not as finished, legally cleared content
- You are responsible for reviewing all AI-generated content before publishing
- You must ensure AI-generated content does not infringe third-party intellectual property rights
- You must comply with TikTok's disclosure requirements for AI-generated or commercial content
- You must comply with Meta's branded content and disclosure policies for Facebook and Instagram
- Socialee does not claim ownership of content you publish through the platform
6. Prohibited Uses
You must not use Socialee to:
- Post content that violates TikTok Community Guidelines or applicable laws
- Engage in spam, artificial inflation of metrics, or platform manipulation
- Post content that is defamatory, harassing, obscene, or discriminatory
- Infringe copyrights, trademarks, or other intellectual property rights
- Conduct any activity that violates Malaysia's Communications and Multimedia Act 1998 or Thailand's Computer Crimes Act
- Attempt to circumvent platform security or access systems you are not authorised to use
- Use the platform for any unlawful commercial purpose
7. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
- Ensuring your TikTok account complies with TikTok's terms before connecting to Socialee
8. Disclaimers & Limitation of Liability
Socialee is provided on an "as is" and "as available" basis. We do not guarantee:
- That the platform will be uninterrupted, error-free, or secure at all times
- Specific results, engagement rates, follower growth, or business outcomes
- That AI-generated content will be accurate, complete, or suitable for your specific use
- Continued availability of TikTok API integrations (subject to TikTok's policies)
To the maximum extent permitted by applicable law, Socialee shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of revenue, data, or business opportunity.
9. Indemnification
You agree to indemnify and hold harmless Socialee, Gaman Group Sdn Bhd, White Ball Company Co. Ltd, and their respective officers, directors, and employees from any claims, damages, or expenses arising from:
- Your use of the platform
- Content you post through Socialee
- Your violation of these Terms
- Your violation of TikTok's terms or applicable laws
10. Intellectual Property
All platform technology, design, trademarks, and proprietary AI systems are owned by Socialee / Gaman Group Sdn Bhd / White Ball Company Co. Ltd. You may not copy, reverse-engineer, or reproduce any part of the platform without prior written consent.
11. Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in prohibited uses as outlined in Section 6
- Violate TikTok's terms in a manner that affects our API access
- Violate Meta's platform policies in a manner that affects our Facebook or Instagram API access
You may terminate your account at any time by contacting us. Upon termination, your data will be handled in accordance with our Privacy Policy.
12. Governing Law & Dispute Resolution
These Terms are governed by:
- Malaysia users: The laws of Malaysia. Disputes shall be subject to the jurisdiction of Malaysian courts.
- Thailand users: The laws of Thailand. Disputes shall be subject to the jurisdiction of Thai courts.
We encourage users to contact us first to resolve disputes amicably before initiating legal proceedings.
13. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
